1. Who you're contracting with

GrowthGiant is a product operated by QAMY (Registration No. BN688240626), a business registered in Ghana ("QAMY", "we", "us", "our"). By accessing or using the GrowthGiant platform, website, or any related services (the "Service"), you enter into a binding agreement with QAMY.

2. Acceptance of these terms

By creating an account, accessing the Service, or continuing to use it after these terms are updated, you agree to be bound by these Terms & Conditions and any policies referenced within, including our Privacy Notice and Refund Policy. If you do not agree, you must not use the Service. If you are using the Service on behalf of an organization, you confirm you have authority to bind that organization. If you are an individual, you confirm you are of legal age in your jurisdiction.

3. What GrowthGiant is

GrowthGiant is an autonomous, AI-powered marketing operating system composed of nineteen engines spanning strategy, content, advertising, CRM, analytics, and automation. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service within the plan you have subscribed to.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

• use the Service for any unlawful, fraudulent, or deceptive purpose;
• send spam, phishing, or unsolicited bulk communications through the Service;
• infringe the intellectual property, privacy, or other rights of any third party;
• upload malware, probe, scan, or otherwise interfere with the security of the Service;
• scrape, resell, sublicense, or redistribute the Service or its outputs beyond your plan;
• reverse engineer, decompile, or attempt to circumvent technical limitations;
• use the Service to generate content that is illegal, hateful, harassing, sexual content involving minors, deepfakes intended to deceive, or malware;
• attempt to bypass safety filters, moderation, or usage limits ("jailbreaking").

5. Your account & content

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date. You retain ownership of the content, prompts, brand assets, and data you submit to the Service ("User Content"). You grant us a limited, worldwide, royalty-free license to host, process, transmit, and display User Content solely to provide, secure, and improve the Service.

6. AI-generated outputs

GrowthGiant uses artificial intelligence to generate strategies, copy, images, and other outputs ("Outputs"). You are responsible for the prompts you provide, for reviewing Outputs before use, for verifying their accuracy, and for ensuring you have the rights needed for any material you feed into the Service. Outputs may be inaccurate, incomplete, or unsuitable for your purpose, and must not be relied upon as regulated professional advice (legal, medical, financial, tax, or similar) without independent verification. We reserve the right to filter, refuse, or moderate Outputs, and to suspend accounts that misuse AI features.

If you believe an Output infringes your rights or those of a third party, contact us via /contact and we will investigate. Repeated infringement may result in account termination.

7. Intellectual property

The Service, its software, documentation, engines, branding, and all related intellectual property are and remain the exclusive property of QAMY and its licensors. Nothing in these terms transfers ownership to you.

8. Payments, subscriptions & Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax collection, subscription renewals, cancellations, and refunds are handled by Paddle in accordance with the Paddle Buyer Terms. By purchasing a subscription you agree to those terms in addition to these.

Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your account settings or via Paddle at paddle.net.

9. Service level

We work hard to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted, error-free, or free from security incidents. Scheduled maintenance and third-party dependencies may cause temporary unavailability.

10. Suspension & termination

We may suspend or terminate your access to the Service, in whole or in part, if:

• you materially breach these terms;
• your payment fails and remains unpaid after Paddle's retries;
• we reasonably suspect fraud, abuse, or a security risk arising from your account;
• you repeatedly or seriously violate our acceptable use policy;
• we are required to do so by law.

You may terminate at any time by cancelling your subscription. Upon termination, we will provide a reasonable window to export your data before deletion, subject to legal retention requirements.

11. Warranties & disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the fullest extent permitted by law, QAMY's aggregate liability arising out of or in connection with the Service is limited to the fees you paid for the Service in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential, incidental, special, or punitive damages, including loss of profits, revenue, data, or goodwill. Nothing in these terms limits liability for fraud, death, or personal injury caused by our negligence, or any liability that cannot be excluded by law.

13. Indemnity

You will indemnify and hold QAMY harmless from any third-party claim arising out of your User Content, your unlawful use of the Service, or your breach of these terms.

14. Governing law

These terms are governed by the laws of the Republic of Ghana. The courts of Ghana have exclusive jurisdiction over any dispute arising out of or in connection with the Service, subject to any mandatory consumer protection rights in your country of residence.

15. Changes to these terms

We may update these terms from time to time. Material changes will be notified through the Service or by email. Continued use after the changes take effect constitutes acceptance.
